exactly. Imagine how big of a dipshit he must have been for the cops to not let him go.Wild he was still living in IC.
And LOL fucking state of Iowa. Arresting and jailing someone for weed.
Not sure Lee.It’s been years since I left Iowa city, but I thought weed possession used to be a mandatory to the station arrest in IC?
Not sureIowa hasn't legalized the devils lettuce yet?
There’s a mandatory minimum sentence of two days in jail for marijuana possession. If you get arrested for it, they’ll take you into custody and hold you until you can see the magistrate (usually the next morning). The good news is that you will usually get credit for the time you are held against the mandatory minimum sentence. It’s been years since I left Iowa city, but I thought weed possession used to be a mandatory to the station arrest in IC?
Minimum 2 days gone (you do get the overnight stay), and they also repealed the 6 mo. loss of driver's license. Good to know. It’s been 16 years since I’ve been anywhere near an Iowa criminal matter.Minimum 2 days gone (you do get the overnight stay), and they also repealed the 6 mo. loss of driver's license. Qim's gone soft on drugs:
5. a. It is unlawful for any person knowingly or intentionally to possess a controlled substance unless such substance was obtained directly from, or pursuant to, a valid prescription or order of a practitioner while acting in the course of the practitioner’s professional practice, or except as otherwise authorized by this chapter. Any person who violates this subsection is guilty of a serious misdemeanor for a first offense. A person who commits a violation of this subsection and who has previously been convicted of violating this chapter or chapter 124B or 453B, or chapter 124A as it existed prior to July 1, 2017, is guilty of an aggravated misdemeanor. A person who commits a violation of this subsection and has previously been convicted two or more times of violating this chapter or chapter 124B or 453B, or chapter 124A as it existed prior to July 1, 2017, is guilty of a class “D” felony. b. If the controlled substance is marijuana, the punishment shall be by imprisonment in the county jail for not more than six months or by a fine of not more than one thousand dollars, or by both such fine and imprisonment for a first offense. If the controlled substance is marijuana and the person has been previously convicted of a violation of this subsection in which the controlled substance was marijuana, the punishment shall be as provided in section 903.1, subsection 1, paragraph “b”. If the controlled substance is marijuana and the person has been previously convicted two or more times of a violation of this subsection in which the controlled substance was marijuana, the person is guilty of an aggravated misdemeanor
You also have to obtain at your expense a substance abuse evaluation. Possible to end up on probation (deferred, bad record, or tied to other charges) and have to follow the recommendation of the evaluation, typically for outpatient group. Usually a fine in some amount ($430 often as standard minimum for serious misdemeanor-even though not actual minimum for this charge), pay 15% surcharge, court costs, and attorney fees if atty appointed. Possible to obtain waiver of costs/fees if you lack the "reasonable ability to pay" and file a request and 5 page financial affidavit within 30 days of sentencing.Good to know.
