I bet that Terry was just sitting at Panchero’s, eating a burrito and minding his own business, when the cops burst in, searched him, and arrested him for weed possession.

That’s probably what happened.

It’s been years since I left Iowa city, but I thought weed possession used to be a mandatory to the station arrest in IC?

There’s a mandatory minimum sentence of two days in jail for marijuana possession. If you get arrested for it, they’ll take you into custody and hold you until you can see the magistrate (usually the next morning). The good news is that you will usually get credit for the time you are held against the mandatory minimum sentence.

Minimum 2 days gone (you do get the overnight stay), and they also repealed the 6 mo. loss of driver's license. Qim's gone soft on drugs:

A person who commits a violation of this subsection and who has previously been convicted of violating this chapter or chapter 124B or 453B, or chapter 124A as it existed prior to July 1, 2017, is guilty of an aggravated misdemeanor. A person who commits a violation of this subsection and has previously been convicted two or more times of violating this chapter or chapter 124B or 453B, or chapter 124A as it existed prior to July 1, 2017, is guilty of a class “D” felony. b. If the controlled substance is marijuana, the punishment shall be by imprisonment in the county jail for not more than six months or by a fine of not more than one thousand dollars, or by both such fine and imprisonment for a first offense. If the controlled substance is marijuana and the person has been previously convicted of a violation of this subsection in which the controlled substance was marijuana, the punishment shall be as provided in section 903.1, subsection 1, paragraph “b”. Good to know. It’s been 16 years since I’ve been anywhere near an Iowa criminal matter.

You also have to obtain at your expense a substance abuse evaluation. Possible to end up on probation (deferred, bad record, or tied to other charges) and have to follow the recommendation of the evaluation, typically for outpatient group. Usually a fine in some amount ($430 often as standard minimum for serious misdemeanor-even though not actual minimum for this charge), pay 15% surcharge, court costs, and attorney fees if atty appointed. Possible to obtain waiver of costs/fees if you lack the "reasonable ability to pay" and file a request and 5 page financial affidavit within 30 days of sentencing.
All for one joint. Cuckoo for Coco Puffs.

Buddy is a PD, this crap is a real pet peeve of mine. Edibles and vapes everywhere, legal states all around us, not prosecuted in some places, and cops look the other way in other places. Yet it is prosecuted, many cops do arrest, and thousands are hassled and criminalized every year because Qim's a drunk.
